Welcome to CruiseClub Australia (“CruiseClub”, “we”, “us” or “our”), operated by Allen Suss, a Personal Travel Manager operating under TravelManagers Australia Pty Ltd ACN 113 085 626. By accessing or using our website at cruiseclub.com.au (the “Website”) you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Website.
1. About CruiseClub
CruiseClub Australia is a membership-based travel service specialising in luxury, expedition, river and world cruise experiences. CruiseClub is operated by Allen Suss as a Personal Travel Manager under TravelManagers Australia Pty Ltd, part of the House of Travel Group. All bookings are made through TravelManagers Australia Pty Ltd, which holds the relevant Australian travel industry accreditation.
2. Membership
CruiseClub membership is free of charge and carries no obligation to book. By registering as a member you agree to provide accurate and current personal information. We reserve the right to suspend or terminate membership at our discretion if we reasonably believe information provided is inaccurate or membership is being misused.
3. Travel Services and Bookings
CruiseClub acts as an agent for third-party travel service providers including, but not limited to, cruise lines, airlines, hotels and tour operators. When you make a booking through us:
- your contract for travel services is with the relevant travel service provider, not with CruiseClub or TravelManagers Australia;
- you are bound by the terms and conditions of each travel service provider, including their cancellation and refund policies;
- all quoted prices are subject to availability and may change without notice until a booking is confirmed and a deposit is received;
- prices are quoted in Australian Dollars (AUD) unless otherwise stated.
4. Payments
All payments are processed through TravelManagers Australia Pty Ltd secure client trust accounts. Payment schedules, deposit amounts and final payment deadlines are determined by the applicable travel service provider. It is your responsibility to ensure payments are made by the required dates. Failure to pay on time may result in cancellation of your booking and applicable cancellation fees.
5. Cancellations and Refunds
Cancellation and refund policies are set by the individual travel service providers. We will inform you of the applicable cancellation terms at the time of booking. Any request for cancellation must be made in writing to us. We strongly recommend you take out comprehensive travel insurance at the time of booking to cover cancellation, medical expenses and other unforeseen circumstances.
6. Travel Insurance
We strongly recommend that you obtain comprehensive travel insurance for all bookings. Travel insurance should cover, at minimum, cancellation costs, medical expenses, luggage and personal effects, and personal liability. It is your responsibility to ensure that your insurance coverage is adequate for your travel arrangements.
7. Travel Documents and Health Requirements
It is your responsibility to ensure you hold a valid passport, visas and any other documentation required for your travel arrangements. You are also responsible for meeting all health and vaccination requirements for your destinations. We may provide general guidance but are not liable for any issues arising from inadequate travel documentation or failure to meet health requirements.
8. Limitation of Liability
To the maximum extent permitted by law:
- CruiseClub, Allen Suss and TravelManagers Australia act as agents for third-party travel service providers and are not liable for any loss, damage, injury, delay or additional expense caused by the acts, omissions, defaults or negligence of any travel service provider;
- we are not liable for any loss or damage arising from events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, civil unrest, strikes, weather events or technical failures;
- our liability to you for any claim relating to services provided through the Website is limited to the fees (if any) paid by you directly to us, excluding amounts paid to third-party travel service providers.
Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded by agreement.
9. Website Use
You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, the Website by any third party. You must not:
- use the Website in any way that may cause damage or impair its availability or accessibility;
- use the Website to transmit any unsolicited or unauthorised advertising or promotional material;
- attempt to gain unauthorised access to any part of the Website, the server on which it is stored, or any server, computer or database connected to the Website;
- reproduce, duplicate, copy or otherwise exploit any content on the Website for commercial purposes without our express written consent.
10. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images and software, is the property of CruiseClub Australia or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify or create derivative works from any content on the Website without our prior written consent.
11. Privacy
Your use of the Website is also governed by our Privacy Policy, which forms part of these Terms of Service. Please review it to understand how we collect, use and protect your personal information.
12. Third-Party Links
The Website may contain links to third-party websites. These links are provided for your convenience only and do not imply endorsement. We are not responsible for the content or privacy practices of any linked websites.
13. Amendments
We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes will be posted on this page and the “Last updated” date will be revised accordingly. Your continued use of the Website following any changes constitutes acceptance of the updated terms.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
